Eric Qi is an experienced lawyer at Fumens Lawyers, practising in commercial litigation, corporate and commercial transactions, and China–Australia cross-border matters. He holds a Master of Laws (LL.M.) from China and a Juris Doctor (J.D.) from Australia, with dual legal qualifications in Victoria and China, and advises clients in both Mandarin and English.
In commercial litigation and dispute resolution, Eric acts for companies and individuals before Victorian courts and tribunals at all levels, including VCAT, the Magistrates’ Court, the County Court and the Supreme Court of Victoria, as well as in New South Wales proceedings. His recent work spans commercial lease disputes, contract and debt claims, misleading and deceptive conduct claims, corporate winding-up and shareholder disputes, defamation, and bankruptcy proceedings. He regularly briefs counsel and conducts mediations and settlement negotiations.
In China–Australia cross-border matters, Eric assists Chinese creditors with the recognition and enforcement of Chinese judgments in Australian courts, including applications for freezing orders and asset disclosure orders. He acts in cross-border debt recovery, combining letters of demand, caveats and litigation, and advises on cross-border estates, including the administration of Australian assets for families in China.
In corporate and commercial law, Eric provides services for business transactions of all sizes: he drafts and negotiates share sale and transfer agreements, shareholders agreements, loan and security documents, trust deeds and deeds of variation, business sale and purchase contracts, and commercial leases, and advises on related FIRB compliance matters.
In wills, estates and private wealth, Eric prepares wills, enduring powers of attorney and medical treatment decision maker appointments, establishes and varies family and bare trusts, and documents intergenerational loan and mortgage arrangements for family property purchases.
