离婚财产分割中难啃的骨头 ——养老金分割 在之前的文章中我们给大家介绍了离婚的程序与如何处理财产分割。在澳洲,离婚分割财产时,养老金是相对特殊的一块,究其原因是养老金有其特殊的立法规定。这周我们就为大家来介绍一下离婚后养老金如何分割处理。 01 分割方法 一般来说,《家庭法》(Family Law Act 1975)和《家庭法(退休金)条例》(Family Law (Super) Regulations 2001)是处理夫妻退休金利益分割的法律依据。与一般的财产分割无异,退休金可以通过以下方法分割: 1.       同意令(Consent Order); 2.       双方之间具有约束力的婚前/婚后协议Binding Financial Arrangement (BFA); 3.       法院判决。 使用同意令或BFA的方式分割养老金在澳洲是最为常见的。但需要注意的是,与普通财产分割不同,即使双方使用法院同意令或是BFA的方式分割退休金,也不是双方同意就可以分割了,还需要将双方都同意的提案交由养老金公司(Trustee)同意。只有相应提案被养老金公司所接受,法院才会下达同意令或者说BFA才会生效。 如果双方在养老金分割上无法达成协议,则一般需要由法院来判决养老金的分割,从实务中来看,通常最常见的分割方式是将双方的养老金数额相加,进行对半分割。 02 如果对方不肯披露养老金的具体数额怎么办? 如果对方不肯披露养老金的具体数额,您可以通过下方链接获取Family Court官网提供的表格,并把填写好的表格递交给相关的养老金公司。养老金公司会酌情提供相关养老金的信息。 http://www.familycourt.gov.au/wps/wcm/connect/fcoaweb/forms-and-fees/court-forms/diy-kits/kit-diy-superannuation-info 03 养老金不能分割的情形 在少数情况下,养老金可能会被认定是不能被分割的,例如: –          养老金账户的累计金额低于$5000; –          最近两年内收到的临时伤残津贴; –          基于同情或经济困难等理由,提前支付的养老金。 虽然在这些少数情况下,养老金有可能会被认定为无法分割。但是视具体情况,法院仍然有可能将不能分割的养老金认为是夫妻共同财产并进行分割。 04 自主管理的养老金 如果您与您的配偶自主管理养老金(SMSF),那么您的情况将变得非常复杂,特别是在您的配偶也是该SMSF受托人的情况下。通常来说你们关系的破裂并不能免除您或您配偶作为受托人的责任。一般来说,受托人必须继续在任何时候都以所有成员的最佳利益行事,并且必须继续按照相关法律行事,您不能: –          将另一位受托人排除在决策过程之外; –          无视另一位受托人转移养老金的要求; –          采取任何Superannuation Industry (Supervision) Act...
